Set out in the New Rio Doce Agreement, the program run by Samarco has already issued 349 settlement offers to eligible claimants who entered as of last Monday
The Definitive Compensation Program (PID) recorded 3,562 entries in the first 4 days after the platform reopened, which began on May 18 at the request of the Justice Institutions. Of the total claims, 349 have already received offers, 211 of which have already been accepted and are pending judicial approval so payment can be made. 84% (2,674 cases) are under document review, which is the stage when the claimants' documents (individuals or companies) and the power of attorney for the lawyer or statement of assistance by the public defender are checked.
The reopening will allow admission to eligible individuals and companies whose claims were closed due to the submission of an invalid power of attorney or who had not previously entered the platform, if they wish to do so.
The initiative will also allow people who rejected the compensation offer, or who missed the deadline to accept it or to correct their identity document and proof of address, to have a new opportunity to respond within the system.
Admission to the PID can take place through the Public Defender's Office, which offers completely free service, or a private lawyer. The fees provided for in the agreement are paid by Samarco, without deduction from the compensation amount. Additional amounts agreed as attorney fees will not be paid by the company.
The eligibility criteria follow the parameters defined in the New Rio Doce Agreement. These include being over 16 years old on the date of the Fundão dam breach, having requested registration with the now-defunct Renova Foundation by December 31, 2021 or having entered the Novel system by September 29, 2023, without a prior settlement agreement, and having filed a lawsuit by October 26, 2021 without a ruling on the merits.
304,000 people compensated by the PID
The PID is the main compensation channel provided for under the New Rio Doce Agreement and provides individual compensation of BRL 35,000 for eligible individuals and legal entities. By April 2026, more than 304,000 compensation payments had already been made by the program, surpassing the BRL 11.2 billion disbursed mark, an amount that boosts the economy of eligible localities.
